The Department of Homeland Security has undertaken a massive enforcement effort directed at employers who fail to correctly verify the employment authorization of all employees, as well as those who hire undocumented workers. While the SWAT team-like work site enforcement raids against employers who knowingly hire undocumented workers have been getting most of the publicity, the government is increasingly focusing on I-9 audits to ensure that all employers are checking the employment authorization of their workforce. U.S. Immigration and Customs Enforcement (ICE) launched a bold, new audit initiative with a series of Notices of Inspection (NOIs) audits to over 1,800 businesses nationwide on three days in an eight month period - which is more than ICE issued throughout all of 2008! In April 2009, ICE implemented a new, comprehensive strategy to reduce the demand for illegal employment and protect employment opportunities for the nation's lawful workforce. Under this strategy, ICE is focusing its resources on the auditing and investigation of employers suspected of cultivating illegal workplaces by knowingly employing illegal workers. The nationwide initiative is a direct result of this new strategy. It is therefore important to ensure that your I-9s are correctly completed for all employees, including U.S. citizens.
